J&K govt to pay blind man Rs 14 lakh for medical malpractice

A local court on Monday awarded Rs. 14.84 Lakhs as compensation to a man who lost his eyesight due to negligence of doctors at a state run hospital in Jammu about 23 years back.

The Jammu and Kashmir Government was directed by Principal District Judge Jammu, Jang Bahadur Singh Jamwal. The court also directed the government to pay the interest @ 7.5% per annum from the date of filling of the suit on the compensation amount.

'The petitioner has become permanently disabled and blind and he requires the services of an attendant throughout his life which the petitioner has to depend upon, the court observed. The doctors were part of hospital, directly under the control of Chief Secretary as such he was liable for all wrongs done by the employees, the court added.

The victim had approached Chest Diseases Hospital, Jammu on October 25, 1989, where he was examined in OPD. 'After conducting all tests, I had approached Dr Veena Gupta in the OPD on October 26, 1989, who had prescribed, anti-tuberculosis treatment consisting of Streptomycine Injections, Ethamputol tablets and INH. I was referred to district tuberculosis centre, Jammu for free disbursal of the medicines,' the petitioner said.

The petitioner was given Ethambutol tablets in loose form. The petitioner's condition deteriorated and he lost his vision. Doctors at AIIMS declared it a case of Ethambutol toxic Amblyopia - blindness was caused due to adverse effect of the drug Ethambutol, prescribed by doctors as a part of anti-tuberculosis treatment.
