The guidance advises consular an embassy officers to evaluate whether an applicants, physical and medical condition might result in the person becoming a public charge by requiring long-term care or relying on government assistance.Earlier in the visa application stage, medical screening was primarily focused on communicable diseases such as tuberculosis and vaccination records. But the new instructions say something different as guidance states that health condition such as cardiovascular diseases, respiratory illness, diabetes, cancer, and obesity among others can require hundreds of thousands of dollars worth of care, and applications may face additional scrutiny. If the applicant appears unlikely to cover those medical costs without seeking public cash assistance.

Obesity And Health Based Visa Denials

Obesity has been listed as a condition that can further trigger other issues like asthma, high blood pressure, and sleep apnoea and its treatment can require a lot of health issues. The guidance even asks visa officers to assess if the applicant has sufficient financial resources to cover any present of future medical needs so that they do not lean on public assistance. Many legal experts have also raised concerns about these guidelines as they claim that it is not right to reject applicants on the basis of hypothetical future scenarios.Even though the instruction is mostly focused on visa applicants who are obese, it is likely to be used most often in the context of applications for permanent residency, such as immigrant visas that lead to green cards, rather than short term, non-immigrant visas. The concern is that applicants with certain health conditions. Those who can become financially dependent on public assistance can be effectively pre screened out.

As for now, state department and the White House have been contacted, but no official response is there. The guidance reportedly originated internally at the state department and was flagged by the research outlet which reviewed the memo sent to the US embassy and other officials which emphasised that applicant health is also now a factor.
